1. Who we are and how these terms apply

These Terms of Use govern your use of Pumli, including its software, local AI features, optional integrations and related Pumli websites. “Pumli”, “we”, “us” and “our” mean ESOTECH LTD; “you” means the person using the service. Our contact is [email protected]. By selecting an expressly labelled acceptance control, you agree to these Terms. If you act for an organisation, you must have authority to bind it. The Privacy Notice explains personal-data processing and is not a waiver of your privacy rights. These Terms apply alongside the applicable app-store licence and purchase terms. Mandatory consumer and data-protection law takes priority where these Terms cannot lawfully vary it.

2. Eligibility and availability

You must be at least 18, or the applicable age of majority, to independently agree to these Terms. A younger person may use Pumli only where permitted by applicable law and the connected provider, with a parent or guardian who accepts these Terms and supervises use. Pumli is not directed to children under 13. Features vary by release, device, operating system, region and provider eligibility. A feature shown in development or preview material is not a promise that it is included in every release. Pumli 3.0 production does not include the Google-account, Outlook, Facebook or WhatsApp Business connectors. Optional online AI, search and other supported connectors are separate choices.

3. Local models, downloads and device resources

You choose which compatible models to download. Model licences, usage restrictions and host terms apply separately. Download sizes can be substantial; downloads and inference consume storage, battery, memory, network allowance and processing resources. A model’s parameter count does not guarantee compatibility, speed, accuracy or available context. A 35B mixture-of-experts model can have fewer active parameters per token; it does not mean that all 35B parameters run simultaneously in memory. Use models appropriate to your hardware. Do not interrupt device protections, bypass model licences or rely on an advertised model family as a guarantee that every related file is supported.

4. AI limitations and appropriate reliance

AI-generated text, research, speech, media, tool choices and arguments are probabilistic. They may be incorrect, incomplete, biased, offensive, fabricated or unrelated to your intention. Sources, citations, progress indicators and successful tool responses do not independently verify accuracy or suitability. Check important facts, external destinations, recipients and proposed actions. Pumli does not provide regulated medical, legal, financial or emergency services and must not be the sole basis for decisions affecting health, safety, employment, legal rights or money. Contact qualified professionals or emergency services when appropriate. Local inference improves control over the processing location; it does not itself make a model more accurate or reliable.

5. Your accounts, credentials and provider charges

You are responsible for choosing providers, maintaining authority to use connected accounts and keeping your device and credentials secure. Do not share credentials you are not entitled to use. Review each provider’s permissions, terms, privacy notice, quotas and fees before connecting. Bring-your-own-key features use your provider account and may create charges payable directly to that provider, including unsuccessful or repeated requests where its pricing permits. Pumli cannot cancel those charges or guarantee a provider’s availability, pricing or retention practices. Remove and revoke compromised credentials promptly. We will not ask you to publish passwords or API keys in chat, feedback or support materials.

6. Connectors and the scope of authorisation

Connectors and iPhone actions are optional. Enabling a connector, granting an operating-system permission or authorising an account gives technical access within its permitted scope. Access may permit reading, creating, editing, publishing or deleting information, depending on the actual tool. It does not mean that a model’s future interpretation will always match your intention. You must have authority over the affected data and account and give clear instructions. Review proposed changes, record identifiers, dates, time zones, recipients and consequences where presented. A tool may complete an external action before an interruption or error appears in Pumli; check the destination before retrying to avoid duplicates.

7. Approvals, automation and irreversible actions

Allow once approves the presented request. Always allow changes the approval policy for supported enabled tools and can allow subsequent operations without repeated in-app prompts. Separate system permissions, email review screens and other mandatory confirmations still apply where implemented. Before enabling automation, consider the data’s importance, the tool’s capabilities and the possibility of unintended changes, disclosure, charges or deletion. Maintain independent backups and supervise consequential tasks. You can pause a connector, change the approval setting, revoke provider access or stop a running task; this may not cancel a request already accepted by a third party or reverse a completed action. An approval authorises the disclosed operation; it does not waive mandatory rights or excuse our own unlawful conduct.

8. Communications, mail and device handoffs

Review the recipient, sending account, subject, message and attachments before sending. In Pumli 3.0 production, email drafting can hand the reviewed message to your installed mail application, whose final sending controls and account selection apply. Pumli cannot guarantee delivery or recall a message after sending. Account-specific Gmail or Outlook flows, where separately made available in development or a future release, require their own authorisation and an explicit email review and Send action. Cancelling the Pumli review does not send the draft. Phone, Messages, Maps and app-opening tools hand off to the relevant operating-system or app interface; you remain responsible for the final action and any network or carrier charges.

9. Voice and generated images or video

Local dictation and optional online realtime voice are different features. An online voice session transmits microphone audio to the selected provider. Do not record another person, clone a voice, use a likeness or upload reference media without the permission or other lawful authority required in your location. Generation services, including image providers and Seedance, may apply safety filters, retention, availability restrictions and usage charges. Generated content may resemble existing material or be inaccurate. You are responsible for required disclosures that content is AI-generated, checking rights and obtaining consent before publishing or commercially using it. Saving to Photos or sharing is your separate choice.

10. Your content and intellectual property

You retain the rights you already hold in your inputs. You grant us only the limited rights necessary to operate the features you request, troubleshoot material you deliberately send to support and meet applicable legal obligations; this is not permission for us to sell your content or train general AI models on it. Any rights in generated output depend on applicable law and the selected model or provider’s terms. We do not promise that an output is unique, copyrightable, non-infringing or fit for a commercial purpose. Pumli’s software, artwork, mascot, name and design remain the property of their respective owners and licensors. Third-party names and logos identify compatibility, not endorsement.

11. Licence and open-source components

Subject to these Terms and the applicable app-store licence, you may install and use Pumli on devices you are entitled to use. Do not resell the app, misrepresent ownership, remove proprietary notices or circumvent access controls. Reverse engineering restrictions apply only to the extent permitted by law and do not limit rights expressly granted by an applicable open-source licence. Separate notices and licences govern included open-source components and downloaded models; those licences prevail for the components they cover. Apple’s standard licensed application end-user agreement applies to the app-store licence unless a different applicable licence is expressly supplied.

12. Prohibited conduct

Do not use Pumli to violate law, infringe intellectual-property or privacy rights, exploit or harm children, create unlawful or non-consensual intimate material, impersonate someone fraudulently, distribute malware, obtain unauthorised access, harass, spam or facilitate unlawful surveillance. Do not use another person’s sensitive information without the necessary authority and lawful basis. Do not bypass model, provider or operating-system safeguards or instruct a connector to access data outside your authorised scope. You are responsible for use you direct; an AI-generated suggestion is not legal permission to carry it out.

13. Fees, purchases and refunds

Any app purchase or in-app purchase is offered with its price and applicable terms at the point of purchase. Apple processes App Store transactions and administers applicable billing, cancellation and refund procedures, subject to mandatory law. Nothing here creates a new subscription or fee that was not disclosed at purchase. Third-party provider fees, mobile data charges and account subscriptions are separate from payment for Pumli. Your statutory cancellation, conformity, repair, replacement, price-reduction and refund rights remain available where applicable.

14. Availability, updates and ending use

We will exercise reasonable care and skill as required by applicable law. Pumli, models and independent services may be unavailable, interrupted, limited or changed. We may provide security updates or modify integrations when required for compatibility, law or provider changes. We do not promise perpetual support for a particular third-party service. Where required, we will give notice, obtain consent or provide an available remedy for a material adverse change. You may stop using the app and disconnect services at any time. We may restrict misuse where necessary and proportionate, subject to applicable law. Stopping use does not automatically delete third-party copies, revoke provider permissions or undo completed operations.

15. Warranties and allocation of responsibility

Except for obligations and guarantees that cannot lawfully be excluded, AI output and independently operated models and services are provided as available, without a promise of uninterrupted availability, factual accuracy, successful execution, data recovery or compatibility with every device. You remain responsible for the lawfulness of your instructions, the authority you grant and the review reasonably requested of you. We are not responsible to the extent a loss is caused by unlawful instructions, access outside your authority or independent third-party conduct outside our reasonable control. These statements do not exclude responsibility for our failure to meet applicable duties of care, statutory standards or contractual commitments.

16. Liability and rights that cannot be excluded

To the extent lawful, fair and enforceable, we do not accept liability for indirect or consequential losses, lost business opportunities or business profits arising from use of AI output or independent third-party services. For consumers, any limitation applies only where the relevant law permits it and does not remove compensation for reasonably foreseeable losses resulting from our breach where such compensation is required. Nothing limits liability for fraud or fraudulent misrepresentation; death or personal injury caused by negligence; intentional misconduct; gross negligence where it cannot be limited; mandatory consumer guarantees; unlawful personal-data processing or statutory privacy compensation; or any other non-excludable liability. Granting a permission, selecting Always allow or accepting these Terms does not waive these protections. We do not impose a blanket indemnity requiring consumers to bear our own unlawful conduct.

17. Consumer protections and disputes

The mandatory laws and competent courts of your habitual residence continue to protect you where applicable. These Terms do not require compulsory arbitration, waive a lawful collective remedy or prevent a complaint to a consumer, privacy or other competent authority. Contact [email protected] first if you would like us to try to resolve a concern informally; this is not a prerequisite to exercising a statutory right. Where Australian Consumer Law applies, statutory guarantees and remedies cannot be excluded. Where UK, EEA or other mandatory digital-content rules apply, their conformity and remedy requirements remain effective.

18. Changes, interpretation and contact

We will publish the effective date and make the current Terms available in the app and at https://www.pumliai.com/terms. Material changes requiring notice or renewed agreement will be presented as required by law; mere publication does not override such requirements or retroactively remove accrued rights. If a provision is unenforceable, it is ineffective only to that extent; the remainder continues where lawful. A failure to enforce a provision immediately does not waive it. Questions, complaints and legal notices may be sent to ESOTECH LTD at [email protected]. The Privacy Notice is available at https://www.pumliai.com/privacy.
